Medical Actions
Overview:
Government Code § 19253.5 sets forth the conditions under which an appointing power may medically transfer, demote or terminate, or apply for disability retirement for an employee who, for medical reasons, can no longer perform the duties of his or her existing position. This one-day class explores the conditions and requirements of Government Code § 19253.5. We will also discuss an appointing power's obligations under the ADA and FEHA to reasonably accommodate qualified employees with disabilities and to engage in an interactive process, and how the medical action statute intersects with the reasonable accommodation obligation and workers' compensation laws. The course will also review the Board's precedential decisions on "constructive medical termination" and the new sample "Options Letter" the Disability Task Force has disseminated.
Objective:
The class provides participants with an understanding of the complex (and sometimes conflicting) requirements appointing powers must address when deciding how to respond to employees who have medical conditions that may impact their ability to perform their jobs.
Intended Audience:
The class is designed for departmental staff who regularly interact with or make decisions concerning employees with medical conditions who can no longer perform the functions of their jobs. Union representatives who represent employees with medical conditions may also wish to attend.
